Terms of Service

1. Agreement to Terms

By accessing or using the EIGHTYsx website or platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and subscribers.

The Service is operated by DigitalCloudAdvisor Ltd, trading as EIGHTYsx. References to "we", "us", or "our" refer to DigitalCloudAdvisor Ltd.

2. The Service

EIGHTYsx is a cloud-based operations management platform for food service businesses in the United States. The Service includes inventory tracking, analytics, reporting, integrations, and related features as described on our website.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to active subscribers.

3. Subscriptions & Billing

EIGHTYsx is offered on a subscription basis, billed monthly per location. By subscribing, you agree to pay the applicable fees for your chosen plan.

  • Subscriptions renew automatically each month unless cancelled
  • You may cancel at any time from your account dashboard — cancellation takes effect at the end of the current billing period
  • We do not offer refunds for partial months
  • Prices may change with 30 days' written notice to active subscribers
  • Volume discounts are applied automatically based on the number of active locations

4. Free Trial

We offer a 14-day free trial for new subscribers. No credit card is required to start a trial. At the end of the trial period, you may choose to subscribe or your account will be deactivated. Trial data is retained for 30 days after deactivation.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Upload or transmit malicious code or harmful content
  • Attempt to gain unauthorised access to the platform or other users' accounts
  • Resell or sublicense the Service without our written permission
  • Use the Service for any purpose other than legitimate business operations

We reserve the right to suspend or terminate accounts that violate these terms without refund.

6. Your Data

You retain full ownership of all data you upload or generate within the EIGHTYsx platform ("Customer Data"). We do not claim any ownership rights over your Customer Data.

You grant us a limited licence to process and store your Customer Data solely for the purpose of providing the Service. See our Privacy Policy for full details on how we handle your data.

On cancellation, you may export your data within 30 days. After 30 days, data may be permanently deleted.

7. Intellectual Property

The EIGHTYsx platform, website, brand, and all associated content are the intellectual property of DigitalCloudAdvisor Ltd. You may not copy, reproduce, or create derivative works from any part of the Service without our prior written consent.

8. Uptime & Support

We target 99.9% platform uptime, delivered through our AWS infrastructure. Planned maintenance windows will be communicated in advance. We do not guarantee uninterrupted availability and are not liable for losses resulting from downtime outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, DigitalCloudAdvisor Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of profits, data, or business opportunities.

Our total liability to you for any claim arising under these Terms shall not exceed the total fees paid by you in the 3 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless DigitalCloudAdvisor Ltd and its officers, employees, and partners from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer law applies in your jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We will notify active subscribers of material changes by email with at least 14 days' notice.
